Alimony is still an issue in Louisville and Kentucky divorces.  Kentucky law allows alimony however it is not normally granted in short term marriages, or when the parties have relatively equal incomes. 

Alimony – can be:

Permanent Alimony is paid until ex spouse dies, or remarries.  Some Kentucky alimony awards have provisions if the ex is living with another person.

Lump sum Alimony A large alimony payment so future payments and liability is avoided.

Temporary Alimony When alimony payments are for a limited time. 

Rehabilitative Alimony When Alimony payments are made until the ex spouse becomes self-sufficient or has completed their education.  This is the most common form of alimony in our Louisville or Kentucky Courts.

Kentucky still considers fault in consideration of alimony. The needs of the ex spouse, ability to pay and standard of living are considerations for alimony, but  custody of the children is not. Contributions to the education of children is an alimony support factor. 

In order to win alimony a person must show that the other party has the income to pay it over and above his reasonable budget for living expenses.  Further you have to prove that the party requesting needs the income and that you are unable to exist without this support.  Also you should show that you are making reasonable attempts to limit your expenses and to become self-sufficient.  Alimony is tax deductible to the person paying and it is a taxable item to the person getting it.  Also if you get alimony it may be that you are not able to receive AFDC,  SSI or other benefits.  Divorces are sometimes bitter and sometimes it is impossible to divorce as friends and to reasonably split property.  In such cases you need an attorney to get these benefits for you.   In other cases it may be unreasonable to award alimony.  However, if alimony is awarded attorney fees are also often awarded.
